AGREEMENT

This Agreement made on this the day………………, ………….., …….. between Mr. JAYARAJ.P Nihaara Vasthu Designs, First floor V6 building Thodupuzha (hereinafter referred to as ‘Contractor’) of the 1st Part and…………..,………… house ………..village, ……………… Taluk, In………………, Dt, …………….. (hereinafter referred to as the Owner/ of the 2nd Part.

WHEREAS the Owner and the title holder in possess of a plot of land at…………………., Sy.No.
…………….., ……………………Village,  …………………..Taluk , ………………………….District, Extent …………………

WHEREAS the Owner desirous of a Single Storied Residential building being constructed on the said plot according to the Architectural drawings. The Contractor has agreed to construct the said building as per the approved Architectural drawing.

WHERE AS the Owner has expressed the intention to entrust the work shown in the Specification of Works annexed to this Agreement to the Contractor for Rs. ………………………./-(Rupees………………………… ………………only )
(ie. Apprx. ………Sq.Ft @ Rs. ………..per Sq.Ft) subject to the following terms and conditions.

Payment for Different Stages of work is also enclosed. The Contractor had agreed to carry out the work subject to the terms and conditions mentioned below.

NOW THESE PRESENTS WITNESSETH AND THE PARTIES HERE TO AGREE AS FOllOWS :­

1           The accepted Sq.Ft. Rates shall include cost of all materials, labor charges, Scaffolding, shuttering, transportation, loading and unloading, conveyance, tollages, labor supervision thereof, hire of all tools and implements, incidental charges, and all that is required for the complete work (at all heights). The accepted rate shall be firm throughout the Contract period and there shall be no upward revision in the accepted rate for any reason whatever.­

2          The Contractor shall construct and erect on the said plot of land (Sy.No ,  Village,  Taluk, Extent –  cents) a Single Storied building in accordance with the approved, drawings and complete the said building with the materials of best quality and in most substantial and workmanlike manner to the satisfaction of the Owner.­

3          In consideration of the work to be done by the Contractor, the Owner will pay to the Contractor an amount of ….…………………(Rupees ………………..Only) as advance at the time of signing this Agreement and the balance amount will be paid in the manner indicated in the Stages of Payment attached to this Agreement.­

4    Time is the essence of this contract. The Contractor shall start the work within Seven days from the date of signing the Agreement and complete the total work in all respects as per the drawings within…………..  months from the start of the work.

If the works is delayed by the Contractor, Owner/Owners representative has the power to engage another Contractor for the satisfactory completion of the work in time. All extra expenses arising shall be recovered from the payments due to the Contractor.

If the Contractor shall desire extension of time for completion of the work on the grounds of his having been unavoidably hindered in its execution or on any other grounds, he shall apply in writing to the Owner.

5     Only First quality material shall be allowed for the work. The samples of all materials shall be got approved by the Owner/Owners representative before using for the work.

All materials required for the execution of the works shall be supplied by the Contractor. Materials so supplied shall have the approval of the Owner or his representative/Architect before using on the works. All the rejected materials shall be removed at once from the site of work at the Contractor’s own cost.

6.    The Contractor has the right to appoint Labours.

7.    Rates for extra items, additional, altered, or substituted work may be calculated as per the additional rates.

8.          It should be the responsibility of the Contractor to set out and carry out the work as per the drawings and as per the Specifications. Errors or mistakes occurred during the construction of the project by the Contractor is to be rectified by himself at his own cost by demolishing or reconstructing wherever mistakes have occurred.

9          Electricity, cement shed, one no of toilet for labours and water shall be arranged by the Owner free of cost at site.

10. If the costs of materials like cement, steel and aggregates etc increased by 10% from the market rate while signing the agreement, owner should pay for the extra amount.

Specification for Residential Building

  1. Earthwork excavation in ordinary soil 0.60×0.60×0.60 in size for foundation.
  2. PCC for foundation 1:4:8 using 40mm broken stone to a thickness of 10 cm for porch piller
  3. DRM for foundation 0.60×0.60cm in size and for basement RRM in CM 1:8 0.45 x0.45cm in size.
  4. R.C.C. Belt in C.M. 1:1.5:3  8mm(I S I) steel as main bars and stirrups 6mm at 18cm c/c.
  5. Basement filling with ordinary soil including watering tamping etc.
  6. PCC 1:4:8 using 40mm broken and 20 mm graded metal  stone to a thickness of 7.5cm for entire flooring.
  7. Super structure wall in cm 1:6 using quality country burnt briks of size 21x10x7 cm in min thickness 21 c.m.
  8. Sunshade RCC 1:1.5:3 using 20mm broken stone, 8 mm (ISI) steel as main bar 15cm apart and 6mm tore steel as distributor 20cm center to center.
  9. Lintel; RCC 1:1.5:3  15cm thick using 20mm broken stone and 4nos 8mm (ISI) as main bars as strips spacing 18cm C/C.
  10. Main slab RCC 1:1.5:3 using 20mm broken stone in 10cm thickness, 8mm (ISI) steel (ISI) as main and distribution bars 15cm center to center.
  11. Beams and columns are to be provided as per the requirements in the plan.
  12. Plastering all wall inside and outside with 1:5cm,(min12cm thick)
  13. Ceiling and on Roof tops, sunshade plastering with cm 1:4.
